The NSW FOGO Mandate (and what’s changing)
FOGO is now mandatory across NSW, and compliance expectations are rising
The Protection of the Environment Legislation Amendment (FOGO Recycling) Act 2025 introduces mandatory Food Organics & Garden Organics (FOGO) separation and recycling across New South Wales.
From 1 July 2026, a wide range of businesses and institutions must separate food and garden organics from general waste, including:
Supermarkets
Cafes, restaurants & hospitality venues
Hospitals & aged care
Schools, childcare & universities
Correctional facilities
Large commercial waste generators
Councils are also required to expand or implement FOGO services, with statewide household coverage mandated by 1 July 2030.
What this means
More organic waste entering processing systems
Higher scrutiny on contamination
Increased reporting and traceability requirements
Stronger expectations for landfill diversion performance
Topsoil Organics provides the compliant processing, reporting, and advisory support required to meet these obligations.
How we support FOGO Compliance

EPA‑Aligned Organics Processing
Our facilities operate in accordance with NSW EPA guidelines for organic waste handling, processing, and environmental protection. This includes controlled processing conditions, contamination management, and responsible end‑product distribution.

FOGO Contamination Management
We help councils and operators reduce contamination through accepted materials guidelines, intake checks, contamination reporting, and education support.
What councils and operators must demonstrate and how we help

By processing food and garden organics into high‑quality compost and soil conditioners, we help NSW councils and businesses:
