The NSW FOGO Mandate (and what’s changing)

FOGO is now mandatory across NSW, and compliance expectations are rising

The Protection of the Environment Legislation Amendment (FOGO Recycling) Act 2025 introduces mandatory Food Organics & Garden Organics (FOGO) separation and recycling across New South Wales.

From 1 July 2026, a wide range of businesses and institutions must separate food and garden organics from general waste, including:

  • Supermarkets

  • Cafes, restaurants & hospitality venues

  • Hospitals & aged care

  • Schools, childcare & universities

  • Correctional facilities

  • Large commercial waste generators

Councils are also required to expand or implement FOGO services, with statewide household coverage mandated by 1 July 2030.

What this means
  • More organic waste entering processing systems

  • Higher scrutiny on contamination

  • Increased reporting and traceability requirements

  • Stronger expectations for landfill diversion performance

Topsoil Organics provides the compliant processing, reporting, and advisory support required to meet these obligations.
